1. Terms of use for the Fitness Centre
A. LIABILITY RELEASE FOR THE USE OF THE FITNESS CENTRE (THE “RELEASE”)
Based on the permission granted by the client, hereinafter referred to as “the Client” to use the facilities, equipment, and services of the Olympe Inc. fitness centre located in the province of Quebec (hereinafter “Olympe” or “the Centre”) to engage solely in recreational activities, fitness training or physical conditioning, therefore for wellness activities unrelated to work, hereinafter an “Activity” or collectively “Activities,” anyone who wants to use the Centre must read and accept this Release before accessing the site and as an essential condition to the use of the Centre and all the equipment therein.
- I am solely responsible for determining whether I am physically and medically capable of participating in an Activity and/or using the equipment in the Centre or whether a physical or medical examination is necessary before participating in such an Activity and/or using the equipment in the Centre. I will comply with any decision, limitation or recommendation from my physician or health care provider. Before, during and after an Activity, I am solely responsible for determining my physical state of health and whether I can or should interrupt my participation in the Activity and/or stop using the equipment in the Centre or take other measures to protect my health and safety. the Client has no obligation to ensure my physical or medical ability to participate in these Activities and/or use the equipment in the Centre before, during or after those Activities and/or using the equipment.
- In order to use the Centre, I must accurately complete the “Lead an Active Life” questionnaire. If the state of my health changes, I must complete a new questionnaire. Furthermore, the Client will assume no responsibility or obligation whatsoever regarding the state of my health or any consequence related to my health or any other information I may have included in my “Lead an Active Life” questionnaire because they are my sole responsibility. the Client will have no responsibility or obligation whatsoever with respect to topics or conditions related to my state of health that were not declared as required above.
- I agree and acknowledge that participating in the Activities and using the equipment in the Centre could result in personal harm, loss, injury or damage, whether material, corporal or moral, which could be serious and even fatal.
- the Client gives no guarantee that the Centre and the equipment therein or the physical location of any Activity is safe and appropriate for such Activity and/or that all the equipment used is in good working condition. It is solely my personal obligation to ensure that the site of the Centre and the equipment are safe and appropriate for my use.
- This Release constitutes a warning of the dangers brought to my attention before I participate in the Activities and use the equipment in the Centre. Thus, the Client will have no obligation to repair any damage resulting from participation in the Activities and/or the use of the equipment in the Centre.
- This Release applies particularly to all Activities conducted at the Centre and to the use of the equipment therein, regardless of the date or nature of the Activities.
THEREFORE, WHERE PERMITTED BY LAW AND WITHOUT LIMITING THE GENERALITY OF THE FOREGOING:
- I voluntarily and knowingly accept all risks and dangers associated directly or indirectly with the Activities, with my participation in these Activities, and with my presence in the Centre and the use of all the equipment therein.
- I also waive any right to pursue legal action against the Client and Olympe, and release and discharge them, their leaders, directors, shareholders, employees, representatives, affiliates, successors and assigns (collectively, the “Released Parties“) irrevocably and unconditionally from any liability whatsoever and under any law with regard to any recourse, claims, lawsuits, administrative actions which I or my successors, executors, administrators, insurers, personal representatives, and assigns (collectively, the “Releasees“) might have against them directly or indirectly for personal, material or moral damages, losses, injuries, death or any other loss of any type whatsoever that may result from my presence at the Centre and the use of the equipment therein, from the Activities or from any other cause, whether it is due to the fault or negligence of the Released Parties or otherwise.
- Furthermore and under the same terms, I irrevocably and unconditionally waive, on my own behalf and on behalf of the Releases, any recourse, claim, lawsuit, or administrative action past, present, future or potential against any person or entity, including but not limited to, the Client, Olympe and all Released Parties that may one way or another be responsible directly or indirectly for mentoring, managing or supervising my Activities or my presence in the Centre or the use of the equipment therein, other people’s Activities or anyone that owns, manages, rents or maintains the Centre where the Activities take place.
- I agree to release the Client and the Released Parties from all liability and indemnify them without limitation for any injury, disability, loss, death, damage to person or property that may arise due to my participation in the Activities or my presence at the Centre or the use of the equipment therein.
- I understand and acknowledge that my participation in any Activity, my presence in the Centre and the use of the equipment therein, including related events before or after any Activity, are not part of my employment at the Client and are unrelated to my employment. These are voluntary recreational or sporting Activities that are neither required nor expected as part of my employment. To the extent that my employment with the Client is subject to a fixed and/or predetermined work schedule, I acknowledge that I cannot participate in or attend such Activities and/or be at the Centre during my work hours and I understand that I can only participate in or attend such Activities or be present at the Centre outside my regular work hours. Despite any other legislative or regulatory provision to the contrary, I understand that if I’m injured while participating in or attending one of the Activities, or while present at the Centre or using the equipment therein, this will not constitute an occupational disease or a work accident under the meaning of the Act respecting industrial accidents and occupational diseases. As such, I will be personally liable for all costs of treatment or care and/or any other expenses or financial losses resulting from my participation in Activities or my presence at the Centre or my use of the equipment therein. Without limiting the generality of the foregoing, I further undertake to indemnify the Client and Olympe for any expenses, costs and/or losses of any kind that they may incur in order to contest any claim I might make against the provisions of this Release.
- At all times, I will conduct myself in a safe, reasonable and responsible manner, and I will always comply with the safety rules and other regulations, policies and procedures that may be communicated to me from time to time in connection with the Activities, my presence at the Centre, and the use of the equipment therein.
- I acknowledge that I can use the Centre only during the opening hours posted and that I am not authorized to invite anyone else to use the facilities of the Centre.
- I acknowledge that using the Centre is a purely voluntary and recreational Activity and is not related to my employment in any way whatsoever.
- I acknowledge that I must use the equipment of the Centre safely and I accept all the risks of injury inherent to performing physical activity and the use of the Centre in general according to the above provisions of this Release.
- I acknowledge that it is possible that no supervision may be available at the Centre. I accept and undertake not to use any equipment that is unfamiliar to me if there’s no supervision and to ask for help from a staff member of the Centre, if necessary, each time I use equipment that is unfamiliar to me. I agree never to use the Centre and/or any equipment therein when I am alone.
- I acknowledge that the Client, at its sole discretion, may, at any time and as it deems necessary, discontinue one or more of the Activities, immediately terminate my use of the Centre and/or the equipment therein. Olympe. may at any time impose any rules and regulations related to the use of the Centre and the equipment therein, as it deems necessary. I also acknowledge that Olympe will have the right at any time and without notice to close the Centre or one of its sections which also includes the right to change the opening hours.
- I will not participate in any Activity nor will I go to the Centre or use the equipment therein if I am under the influence of medication, drugs or alcohol or if I suffer from any medical, health, or other condition including but not limited to an illness or injury that could in any way cause harm or injury to myself, to another participant, or to the property of Olympe or the Centre.
- I acknowledge that the Activities take place on private property and that the Centre and the equipment therein also constitute private property and that I may be asked to leave the Centre immediately for any reason determined by Olympe or the Centre at their sole discretion.
- I hereby declare that I acknowledge and accept all the conditions listed hereinbelow related to my participation in Activities and my presence in the Centre and the use of the equipment therein on a strictly voluntary basis that has no direct or indirect link with my employment at the Client.
- I have read and fully understand this Release and I freely accept and assume all the risks and all the obligations mentioned herein. I am aware that this is a contract and I acknowledge that I am accepting it voluntarily and consent to do so freely and with knowledge of its content. I acknowledge that I have had the opportunity to seek any advice I deem appropriate before accepting this Release. I confirm that I am at least eighteen (18) years old and that I am solely responsible for my personal safety.
- I agree that this Release is governed and construed by the laws of the province of Quebec and of Canada that apply and that the judicial courts of Quebec, District of Montreal, shall have exclusive jurisdiction over any matter related directly or indirectly to this Release or its application to me.
B. TERMS OF USE OF THE CENTRE
General Conditions
- To obtain access to the Centre, the user must have created an OlympeFit account (via the mobile application or web platform).
- Membership of the Centre may not be assigned, transferred, or resold in any way.
- Any violation of these Conditions may result in, but is not limited to, a temporary or permanent suspension of my right to access the Centre. I also acknowledge that Olympe reserves the right to add, delete and modify the Centre’s Terms of Use at any time at its sole discretion.
- Users of the Centre are prohibited from selling or consuming any product not approved by Olympe’s management in the Centre, the locker rooms, and any other related area.
- It is forbidden to solicit other users of the Centre for anything.
- The user must keep their access card with them at all times (for example, to allow them to open the locker) and to allow them to be identified.
Guided Training Service
- Upon payment of a fee determined by Olympe, a user can benefit from training services led by a kinesiologist, which take place in three (3) steps:
- Step 1 : Onboarding with a kinesiologist, which consists of four private sessions to learn the basic training movements, their execution and test movement alternatives based on physical abilities for functional development. A progress plan will be given to the user to help them adapt their training.
- Step 2 : Guided workouts with a kinesiologist in groups of 8 people, lasting 45 minutes, focused on the functional movements seen during private sessions (available 3 times a week).
- Step 3 : Transfer of knowledge to daily activities in order to improve the user’s ability to perform and integrate the functional movements.
Group classes
- Upon payment of a fee determined by Olympe, a user can register for group classes. A group class will be officially offered if a minimum of 13 participants are registered for each group class. In this case, the group class will be cancelled.
- Registration for a group class is based on a first-come, first-served basis and space is limited. If there are no more places, users will be placed on a waiting list.
Code of Conduct of the Centre
The Code of Conduct is put in place to ensure the safety, respect and wellbeing of all members, guests and employees of the Centre. The rules are as follows:
- Respect the opening hours and never be alone in the Centre
- Appropriate athletic clothing and shoes must be worn for training. Outdoor shoes are not permitted inside the Centre in order to maintain the cleanliness and hygiene of the facilities.
- The use of a towel is mandatory when using the equipment and machines.
- The consumption of food in the Centre is strictly prohibited.
- Users must put equipment away and clean the machines after each use.
- Equipment and machines must be shared, especially during busy periods.
- In order to preserve the safety of all and the integrity of the equipment, do not drop weights or any other equipment. Please gently place them on the floor after use.
- Out of respect for other users of the Centre, the use of headphones is required when listening to music or other audiovisual content.
- If any equipment is broken or malfunctioning, the user must report it using Valet by scanning the QR code on the piece of equipment concerned so that corrective measures can be taken as soon as possible.
- Users are responsible for respecting the privacy of other users of the Centre, including but not limited to in the Centre’s locker rooms and showers.
- All bags, coats and other personal belongings must be placed in a locker in the locker rooms. All valuable items must be placed in a locker in the locker rooms.
- Users are responsible for emptying and freeing up their locker at the end of their training session.
- Zero tolerance: Hostile or vulgar language, harassment or intimidation, hostile or threatening physical contact, or other conduct of an inappropriate nature will not be tolerated at the Centre. Users must exercise the utmost courtesy and respect for others at all times.

- Keep the place clean.
